I recall that with XIM3 and prior Microsoft's official stance was that they did not care.

As somebody brought up elsewhere with regards to aftermarket controllers, the Xbox Live terms of service 'now' (or did it always?) seems to indicate that any means of communication other than official hardware is against the terms of service.

Has this changed in recent time? Perhaps this was a brouhaha at some point and I missed it. What's the consensus on XIM with relation to the 'new' Terms of Service?

And for the sake of discussion let's not confuse the situation of "is it allowed" with "is it detectable."

Text follows
Quote
Use unauthorized software or hardware to access the Services or modify an Authorized Device in any unauthorized way (e.g., through unauthorized repairs, unauthorized upgrades, or unauthorized downloads). You agree that we have the right to send data, applications or other content to any software or hardware that you are using to access the Services for the purpose of detecting an unauthorized modification and/or disabling the modified device; or
Attempt to disassemble, decompile, create derivative works of, reverse engineer, modify, further sublicense, distribute, or use for other purposes the Services, any game, application, or other content available or accessible through the Services, or any hardware associated with the Services or with an Authorized Device. If you do, we may cancel your account and your ability to access the Services, and pursue other legal remedies. We may take any legal action we deem appropriate against users who violate our systems or network security, this Agreement or any additional terms incorporated or referenced in it. Such users may also incur criminal or civil liability.

I doubt it matters. Sounds more like they are covering their bases....maybe they could do something to you under these terms, but for practical purposes, they seem to be after more malicious activities. In other words, I still doubt they care.

XIM is the only input device that is a true passthrough. The console is always talking to an authorized device.

It is a bit of a grey area imo.  But the unauthorized hardware is not used to gain access to the service/system, the authorized hardware is, nore is the unauthorized hardware used to modify anything.

Its kind of like its a high profile event, with high security, and the controller is on the guest list.  XIM is not on the list, but is the hot date tagging along with the controller.

agreed all the system does is check for the auth signal for a genuine controller and then switch over. Not even sure how ms would detect this as anything foreign unless it goes the way of the ds4 and continuously check for the auth signal. It sees it as a normal controller inputs

Pretty sure ms has more important things to deal with than people trying to use xim to emulate controller inputs. Pretty sure xim is safe.

Agreed another case of lawyers doing an AIO pseudo legal contract to cover their @#$% of everything possible until challenged in court. The usual sign this so we are not libel for anything and we can do what we want standard clause.  Nothing to see here move on.  Xim is not under threat
